Terms of Service

Welcome to EverShelf. By creating an account or using the EverShelf application ("Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. Description of Service

EverShelf is a food storage tracking and meal planning application. It helps users catalog food items, track expiration dates, plan meals, discover recipes, and share surplus food with friends.

2. Eligibility

You must be at least 13 years old to use EverShelf. By using the Service, you represent that you meet this requirement.

3. Account Responsibilities

• You are responsible for maintaining the confidentiality of your account credentials.
• You agree to provide accurate information when creating your account.
• You are responsible for all activity that occurs under your account.
• You must notify us promptly if you suspect unauthorized access to your account.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose.
• Upload malicious content, spam, or harass other users.
• Attempt to gain unauthorized access to the Service or its systems.
• Interfere with or disrupt the integrity or performance of the Service.
• Scrape, copy, or redistribute content from the Service without permission.

5. Food Safety Disclaimer

EverShelf is a convenience tool only. The Service is not a substitute for professional food safety guidance. Specifically:

• Expiration dates tracked in EverShelf are based on user input and general estimates. They may not reflect actual food safety conditions.
• EverShelf is not liable for food safety decisions, expiration accuracy, spoilage, allergic reactions, or any health outcomes resulting from reliance on information provided by the Service.
• Always use your own judgment and follow food safety best practices when deciding whether to consume, share, or discard food.
• AI-generated recipe suggestions and meal plans are for convenience and do not constitute dietary or medical advice.

6. Community Sharing

EverShelf allows users to share surplus food items with friends. When participating in community sharing:

• You are solely responsible for the safety and quality of food items you list for sharing.
• You agree to accurately describe items, including any known allergens.
• EverShelf facilitates connections between users but is not a party to any food exchange and assumes no liability for shared items.

7. Subscriptions and Payments

EverShelf offers a free tier with limited monthly usage of AI-powered features (item detection, recipe auto-complete, and recipe scanning). A Premium subscription removes these limits and provides additional benefits.

• Auto-Renewable Subscription: Premium is offered as an auto-renewable subscription with monthly and annual billing options. Your subscription will automatically renew at the end of each billing period unless you cancel at least 24 hours before the current period ends.
• Payment: Payment is processed through the Apple App Store or Google Play Store. The subscription price is charged to your App Store or Google Play account at confirmation of purchase.
• Cancellation: You may cancel your subscription at any time through your device's App Store or Google Play subscription settings. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused portions of a subscription period.
• Price Changes: We may change subscription prices from time to time. Price changes will not affect your current billing period. You will be notified of any price changes before they take effect.
• Refunds: Refund requests are handled by Apple or Google in accordance with their respective refund policies.

8. User Content

You retain ownership of content you upload (photos, recipes, descriptions). By uploading content, you grant EverShelf a limited, non-exclusive license to use, display, and store that content solely to provide and improve the Service.

9. Intellectual Property

The EverShelf name, logo, and application code are the property of EverShelf. You may not copy, modify, or distribute any part of the Service without written permission.

10. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time. Upon termination, your right to use the Service ceases immediately. Termination of your account does not automatically cancel active subscriptions — you must cancel subscriptions separately through your App Store or Google Play settings.

11. Limitation of Liability

To the maximum extent permitted by law, EverShelf and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to health outcomes, data loss, or service interruptions.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

13. Changes to These Terms

We may update these Terms from time to time. We will notify users of material changes via the app or email. Continued use of the Service after changes constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in accordance with applicable law.
